Terms of Service

The rules of using Hushelo.

Plain English. No surprises. By creating an account or using Hushelo, you agree to these terms. If you don’t agree, you can’t use the app - we’ll refund any unused paid time and help you export your data.

1. Accepting these terms

These terms are a binding agreement between you and Gamalabs (OPC) Pvt Ltd, registered at Plot no 527, Ground Floor, Phase 1, TNGO Colony, Gachibowli, Hyderabad, Telangana - 500032, India (“Hushelo”, “we”, “us”), the operator of the Hushelo mobile app, Apple Watch companion, and this website. By signing up for an account, downloading the app, or using any part of the service, you agree to be bound by these terms and by our Privacy Policy.

You also need to follow Apple’s App Store Terms (on iOS) or Google Play’s Terms (on Android), which apply to the app you downloaded from those stores. If anything in those terms conflicts with ours, those terms control for the store part of the relationship.

2. Your account

To use Hushelo you need to create an account. When you do, you promise that:

  • You are at least 18 years old.
  • The information you provide is accurate.
  • You have the legal right to record information about each baby you add - either because you are the parent / legal guardian, or because the parent / legal guardian has asked you to.
  • You will keep your password secret and you are responsible for everything that happens on your account.
  • You will let us know promptly if you discover unauthorised use of your account by emailing hello@hushelo.com.

We can suspend or terminate accounts that violate these terms, that we believe were created fraudulently, or where there has been no activity for an extended period. We will give you reasonable notice and the opportunity to export your data wherever the law allows us to.

3. Using Hushelo

You agree NOT to:

  • Use Hushelo to record data about someone whose privacy you don’t have the right to capture - for example, a baby that isn’t in your care.
  • Try to break, probe, or reverse-engineer our systems beyond what’s allowed by applicable law for security research.
  • Upload content that’s illegal, harmful, hateful, sexual, or that violates someone else’s rights.
  • Use Hushelo to spam, harass, or scrape data about other users.
  • Misuse a friend or family member’s invite code to access a family you weren’t invited to.
  • Resell, sub-license, or commercially exploit any part of the service without our written permission.

We have automatic rate limits and detection in place. If you trigger them legitimately (a power user, an unusual workflow), tell us and we’ll adjust them for you.

4. Your content stays yours

You keep ownership of everything you put into Hushelo - every feed log, every photo, every note. We do not claim any rights to your content.

You give us a limited, worldwide, royalty-free licence to store, process, transmit, display, and back up your content for the sole purpose of providing the service to you and the caregivers you choose to share with. This licence ends when you delete your content or your account, except where we are legally required to keep certain records (see section 6 of our Privacy Policy).

We will never use your content to train AI models, advertise to you, or sell to third parties.

5. Family sharing

Hushelo lets you invite caregivers into a family. When you do:

  • Every caregiver you invite can see all of the babies in that family and all of the entries logged for them. There is no per-baby access control.
  • You choose the role for each caregiver when you invite them. Admin can do everything; caregiver can log entries; viewer is read-only.
  • Any caregiver you invite is bound by these terms too. By inviting them, you confirm they accept these terms when they sign up.
  • If you delete your account but other caregivers continue to use the family, the family and its records remain so they can carry on. If you are the only caregiver, the family is deleted with you.

You are responsible for managing the people you invite. We’re a tool; we don’t mediate between caregivers over what gets logged or how. Talk to each other.

7. Not medical advice

Please read this section carefully.

Hushelo is a tracking tool, not a medical device. The information shown in the app - including reminders, schedules, percentile charts, growth curves, vaccine schedules, milestone suggestions, and any data summaries - is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

Specifically:

  • Always seek the advice of your pediatrician or other qualified healthcare provider with any questions you have about your baby’s health.
  • Never disregard professional medical advice or delay seeking it because of something you saw in Hushelo.
  • If you think your baby is having a medical emergency, stop using the app and call your local emergency number immediately.
  • Vaccine schedules in the app are based on published guidelines from public health authorities (WHO and country-specific schedules). They’re a reference, not a prescription. Your pediatrician’s actual recommendation is the one to follow.
  • The medication-tracking, growth-chart, and any insight or analytics features are for record-keeping. They are not designed to detect medical conditions or to recommend treatment.

By using Hushelo, you acknowledge and accept these limitations.

8. Our intellectual property

Hushelo - the app, the watch companion, the website, the admin panel, the brand, the logo, the design, the illustrations, the icons, the typography combinations, the copy, the database schema - is ours and is protected by copyright, trademark, and other intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use Hushelo as the app is intended to be used, while you have an account in good standing.

You can’t copy, modify, adapt, translate, decompile, reverse-engineer, or create derivative works of Hushelo except where applicable law expressly allows it. You can’t use our brand, logo, or screenshots for commercial purposes without our written permission.

9. Availability and changes

We aim to keep Hushelo running reliably, but we don’t promise it will be available 24/7 or bug-free. We may take parts of the service offline for maintenance, security fixes, upgrades, or for reasons outside our control (your internet connection, Apple, Google, our hosting provider). We do our best to give advance notice for planned maintenance.

Features may be added, changed, or removed. If we materially reduce a feature you paid for, we’ll tell you in advance and offer a refund of the affected portion of your paid time where the law requires it.

10. Ending your account

You can delete your account at any time from Settings → Account inside the app, or by emailing hello@hushelo.com. There’s a 30-day grace period during which you can cancel the deletion by signing back in. See section 7.3 of our Privacy Policy for what happens to your data after that.

We can suspend or terminate your account if you violate these terms, if we believe your account or content is harmful, or if we’re legally required to. Where possible, we’ll tell you why and give you the chance to export your data before access is removed.

11. Warranty disclaimer

Hushelo is provided “as is” and “as available.” To the maximum extent permitted by applicable law, we disclaim all warranties - express, implied, or statutory - including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.

Some jurisdictions don’t allow the exclusion of certain warranties, so part or all of this section may not apply to you. Where the law gives you a non-excludable warranty, you get the benefit of that warranty.

12. Limitation of liability

To the maximum extent permitted by applicable law, Hushelo and its officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages - including loss of profits, loss of data, loss of goodwill, or other intangible losses - arising out of or related to your use of the service, even if we’ve been told such damages are possible.

Our total aggregate liability for any claim arising out of or related to these terms or the service will not exceed the greater of: (a) the amount you paid us for the service in the 12 months before the event that caused the claim, or (b) USD 50.

Nothing in these terms limits our liability for things the law doesn’t allow to be limited - for example, our own gross negligence, fraud, or wilful misconduct, or non-excludable consumer rights.

13. Indemnity

You agree to indemnify and hold Hushelo harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of: (a) your breach of these terms; (b) your content; (c) your misuse of the service; or (d) your violation of any law or third-party right. We’ll let you know about any claim we receive and you can take over the defence if you want to.

14. Governing law and disputes

These terms are governed by the laws of India, without regard to its conflict-of-laws rules. Disputes will be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India, except where a consumer-protection law in your country requires otherwise - in which case you can bring claims in your local courts.

Before suing, please contact us at hello@hushelo.com so we can try to resolve the issue directly. Most disputes can be worked out without going to court.

15. Changes to these terms

We may update these terms from time to time. When we do, we update the “Last updated” date at the top of this page. If the change is material (for example, changing how you can cancel a subscription), we’ll notify you inside the app or by email at least 30 days before the new terms take effect. Continued use after the change means you accept the new terms; if you don’t accept them you can close your account before they take effect.
